These Terms & Conditions (“Terms”) govern your access to and use of the Painting Kart website (the “Site”) and any products or services offered through it. By using the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

In these Terms, “we”, “us”, and “Painting Kart” refer to the operator of this website. “You” refers to the visitor, customer, or user of the Site.

1. Eligibility

By using this Site you confirm that you are at least 18 years of age, or are accessing the Site under the supervision of a parent or legal guardian, and are legally able to enter into a binding contract.

2. Products & Handmade Nature

All products sold on Painting Kart are handcrafted by artisans. As a result, no two pieces are exactly alike. Minor variations in color, texture, mirror placement, and finish are natural characteristics of the craft and are not considered defects.

Product images on the Site are representative. The actual product you receive may differ slightly in shade or detail due to the handmade process and differences in display screens.

3. Orders & Pricing

All prices are listed in Indian Rupees (INR) unless stated otherwise and are inclusive of applicable taxes unless mentioned. We reserve the right to modify prices at any time before an order is confirmed.

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our sole discretion, including for reasons such as stock unavailability, inaccuracies in listing or pricing, or suspected fraud. In such cases, any amount paid will be refunded to the original payment method.

4. Payments

Payments on this Site are processed through third-party payment gateways (including Razorpay). By making a payment, you agree to the terms and privacy policies of the relevant payment provider. We do not store your card, UPI, or banking credentials on our servers.

5. Shipping, Cancellations & Refunds

Shipping timelines, cancellations, and refund eligibility are governed by our Shipping Policy and Cancellation & Refund Policy, each of which forms part of these Terms.

6. Custom & Made-to-Order Pieces

Custom, personalized, or made-to-order pieces are prepared specifically for you. Once production has begun, these orders cannot be cancelled or refunded unless the piece arrives damaged or materially differs from what was agreed in writing.

7. Intellectual Property

All content on the Site — including photographs, illustrations, product designs, text, logos, and the Painting Kart name — is owned by us or our licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any content for commercial purposes without our prior written consent.

8. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to any part of the Site or its systems.
• Interfere with, disrupt, or impose an unreasonable load on the Site.
• Post or transmit any content that is fraudulent, abusive, or infringing.

9. Limitation of Liability

To the maximum extent permitted by law, Painting Kart and its team will not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the use of the Site or any product purchased through it. Our total liability for any claim relating to an order shall not exceed the amount paid by you for that order.

10. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Your continued use of the Site after any change constitutes acceptance of the revised Terms.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes arising in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in India.
